What is the Mediators
Role?
The mediator:
- Guides and facilitates communication between
the parties in a neutral and objective way
- Cannot act as an advocate for either party
- Assists each party in identifying and clarifying
his or her own interests, needs and concerns
- Generates a range of options for exploration
- Assists the parties in arriving at a mutually
agreeable resolution of their issues
An attorney who is acting as a mediator is not
representing either party and does not recommend settlement positions
or make decisions for the parties.
A psychologist who is acting as a mediator is
not providing therapy during the mediation sessions and does not
diagnose or evaluate the parties. |
