What is the Mediators Role?

The mediator:

  • Guides and facilitates communication between the parties in a neutral and objective way
  • Cannot act as an advocate for either party
  • Assists each party in identifying and clarifying his or her own interests, needs and concerns
  • Generates a range of options for exploration
  • Assists the parties in arriving at a mutually agreeable resolution of their issues

An attorney who is acting as a mediator is not representing either party and does not recommend settlement positions or make decisions for the parties.

A psychologist who is acting as a mediator is not providing therapy during the mediation sessions and does not diagnose or evaluate the parties.
